Download Prasuti ni rjao na pariptro ane niymo 2020:The Maternity Benefit (Amendment) Bill 2017, an amendment to the Maternity Benefit Act, 1961, was passed in the Rajya Sabha on 11 August 2016, in the Lok Sabha on 09 March 2017, and on 27 March, consent was received from the President of India. The 2017 [2] Maternity Benefit Act, 1961 protects the employment of women during her maternity time and entitles her to ‘maternity benefit’ – ie complete absence from work – to take care of her child.

The Act is applicable to all establishments employing 10 or more employees.

The provisions of The Maternity Benefit (Amendment) Act, 2017 are effective from April 1, 2017. However, the provision on the crèche facility (section 111A) will be effective from July 1, 2017.

The Act applies to all establishments, including factories, mines, plantations, government establishments, shops and relevant applicable laws, or any other establishments notified by the Central Government.

The Maternity Benefit Amendment Act has increased the period of maternity leave available to women employees from the current 12 weeks to 26 weeks. Under the Maternity Benefit Amendment Act, this benefit can be availed by women for a period up to a maximum of 8 weeks before the expected delivery date and the remaining time can be availed after delivery.

For women who have 2 or more live children, the duration of paid maternity leave will be 12 weeks (ie 6 weeks before and 6 weeks after the expected delivery date).

Maternity leave for adopted and commissioned mothers:
12-week maternity leave as well as “commissioned mothers” for mothers adopting a child less than three months from the date of adoption.

The commissioning mother is defined as the biological mother who uses her eggs to make an embryo implanted in another woman.
