Subject: - Gujarat  Regarding the amendment in section 30 (a) of the Secondary and Higher Secondary Education Act-12.  The Gujarat Government Gazette SATURDAY, MAY 22, 2021 (2) The Gujarat Government Gazette Notification TUESDAY, JUNE 1,, 1, 2021 

Sir, on the above subject, to state that, with reference letter 1 to Gujarat Secondary and Higher Secondary Education Act-12  GUJARAT ACT No. regarding amendment in section 30 (a).  16 OF 2021 "The Gujarat Secondary and Higher Secondary Education" (Amendment) Act, 2021 has been published.

 Reel 4-2 Gert GUJARAT ACT No. 16 OF 2021 "The Gujarat Secondary and Higher Secondary Education (Amendment) Act, 2021  Implemented from 01/04/2071.  So that instead of the existing provision in Section 41 (a) of Gujarat Secondary and Higher Secondary Education Act 18, the following amendment will have to be considered.

 Existing provision only 05.  In clause (2) of section 12, clauses 3 and 4 and sub-clause of clause (b) of clause (b) of clause (1) and its sub-clauses (2), (2), (2) and (3)  Does not apply to any educational institutions established and administered by a minority based on any text, religion or language?  

Amended provision "30a. Notwithstanding anything contained in this Act, sub-section (1) of section 3, clause (b) of sub-section (1) of section 2 and sub-sections (2), (2)  , (2) and (3) shall not apply to any educational institution established and administered by a minority based on religion or language.

Subject: Matter of amending Section 30-A of Gujarat Secondary and Higher Secondary Education Act 18.  May.  Congratulations on the above subject, to mention that in the last session of the Gujarat Legislative Assembly, a bill amending Section 80-A of the Gujarat Secondary and Higher Secondary Education Act has been passed by the Legislative Assembly on 21/06/2071.  

After the above bill was passed in the Legislative Assembly, a press release was published, which was also communicated to all the District Education Officers.  (Copy included) 

Thus, in secondary and higher secondary schools run by linguistic as well as religious minority institutions, the norms and methods laid down by the State Government in the appointment of staff are applied.  He was earlier exempted from the implementation of Section 13 (2) of the said Act.  After the passage of the said bill, the legal situation has changed, which remains to be implemented by all those involved in the matter.

Gujarat Secondary and Higher Secondary Education Reform Bill has been passed in the Legislative Assembly.  From now on, even in the minority educational institutions in the state, the appropriate qualification along with the TAT examination for the appointment of principals and teachers will be implemented.  The Bill contains amendments consistent with the repeated judgments of the Supreme Court and the Gujarat High Court regarding the implementation of proper qualifications for the appointment of principals and teachers in minority educational institutions.

Giving more details in this regard, Education Minister Chudasama added that the process of selection of candidates in government and subsidized private secondary and higher secondary schools is being implemented in the state through a centralized system.  But such selection procedure is carried out without considering the important marks of the TAT examination prescribed by the minority institutions to meet the qualification for selection as a teacher.

No compromise should be made with quality.HeHedded that as a result of this, the standard for teacher quality selection in government as well as grant-in-aid schools in the state is not maintained and quality selection principals cannot be selected impartially as the selection process is not done in minority institutions on the basis of TAT examination results.  Citing the verdict, the court said it had made it clear that no compromise should be made with the quality of education in the national interest regardless of whether the educational institution is run by a minority or a majority.

The government's decision does not interfere in the administration of minority organizations

The government's decision to set up a regulatory body for the appointment of teachers does not interfere in the administration of minority institutions.  The Gujarat High Court has also issued a judgment in 2013 directing to make necessary amendments in Section 40 (a) of the Gujarat Secondary and Higher Secondary Education Act, 1972.  Earlier in minority schools, the Board of Governors used to conduct recruitment process after determining the educational qualification of the candidate without considering the marks of TAT examination.

North Basic School will be considered a recognized schoolRegarding another provision of the Gujarat Secondary and Higher Secondary Education Reforms Bill, he said that at present the definition of recognized schools includes only the secondary or post-primary schools approved by the Director of Education of the State of Gujarat or the officer authorized by him for this purpose.  According to the amendment bill, such a recognized school will now be considered as a recognized school, namely the Department of Education of the State Government or any other department or, as the case may be, a recognized secondary school or a North Basic School recognized by an official authorized by such department.
